This Terms of Use Agreement (“Agreement”) governs your access to and use of Effectiv Inc.’s (“Effectiv,” “we,” “us,” or “our”) platform, which facilitates the collection and secure transmission of self-reported medication-related information to your healthcare provider. By accessing or using the platform, you agree to these Terms of Use.

 We reserve the right to modify these Terms at any time, and such changes will be effective immediately upon posting the updated Terms on the Site or making them available to you.Your continued use of the Service following the provision of revised Terms signifies that you accept and agree to the changes.

 1. Purpose of the Platform

Effectiv provides a platform that allows patients to answer medication-related questions and submit their responses to their healthcare provider for review. Effectiv does not provide medical advice, diagnosis, or treatment, and no treatment decisions are made within the platform. If you have medical concerns, you should discuss them directly with your healthcare provider. If you are experiencing a medical emergency, call 911 or seek immediate medical attention.

2. Collection and Use of Your Information

As part of using the platform, you will be asked to provide certain personal information, including your name, date of birth, and contact details. This information will only be shared with your healthcare provider and will be handled in accordance with HIPAA standards to ensure confidentiality and security.

3. Your Responsibilities

By using the platform, you agree to:

  • Provide accurate and truthful information when responding to medication-related questions.

  • Understand that your healthcare provider, not Effectiv, is responsible for reviewing your responses and taking any necessary action.

  • Not use the platform for emergency medical concerns. If you need urgent medical assistance, you should immediately contact emergency services.

4. No Medical Advice or Treatment

Effectiv does not diagnose medical conditions, prescribe treatments, or offer medical opinions. The platform is solely a tool to facilitate communication between patients and their healthcare providers. Any healthcare decisions, including medication adjustments or changes in treatment, must be made by your provider, not Effectiv. The platform should never be used as a substitute for professional medical care.

5. Communications & Notifications

By using the platform, you consent to receiving electronic communications regarding your responses. These may include confirmations, reminders, or general notifications related to your participation. However, Effectiv does not provide direct health consultations or emergency alerts. All urgent medical concerns should be addressed directly with your provider.

6. Platform Availability and Limitations

Effectiv strives to provide a secure and reliable platform, but we do not guarantee uninterrupted access or error-free operation. The platform may experience downtime for maintenance or other technical issues beyond our control.

Effectiv is not responsible for any:

  • Loss of access due to system unavailability or technical failures.

  • Delays in transmitting responses to your provider.

  • Data errors, security breaches, or other unforeseen platform issues.

7. Security Measures

 Effectiv implements commercially reasonable security measures such as password protection, encryption, and access controls to safeguard transmitted data. However, you acknowledge that:

  • Effectiv is not responsible for unauthorized access due to factors beyond its control.

  • You must not disable, modify, or circumvent any security measures protecting the platform.

  • Your healthcare provider is responsible for ensuring the confidentiality and security of any patient information received through the platform.

8. User Restrictions

You agree not to:

  • Use the platform for any purpose other than responding to medication-related questions.

  • Submit false, misleading, or offensive content.

  • Attempt to interfere with, disrupt, or compromise the platform’s security.

  • Copy, modify, or distribute any proprietary content from the platform without prior authorization.

9. Termination of Access

 Effectiv reserves the right to terminate or suspend your access to the platform at any time if you violate these Terms of Use or if Effectiv deems it necessary to protect the security and integrity of the platform.

 10. No Warranties; Limitation of Liability

Effectiv provides this platform on an "as-is" and "as-available" basis without warranties of any kind. To the fullest extent permitted by law, Effectiv disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Effectiv does not guarantee that:

  • The platform will be available at all times or free from interruptions or errors.

  • Any information transmitted will be delivered without delay.

  • The service will be free from security vulnerabilities. 

To the fullest extent permitted by law, Effectiv shall not be liable for any:

  • Indirect, incidental, consequential, or punitive damages arising from your use of the platform.

  • Losses related to errors, system failures, or platform unavailability.

  • Medical, legal, or financial consequences resulting from your use of the platform.

11. Indemnification

You agree to defend, indemnify, and hold harmless Effectiv, its affiliates, employees, and agents from all claims, liabilities, losses, or damages arising from:

  • Your use of the platform.

  • Your violation of these Terms of Use.

  • Any third-party claims resulting from your submitted content or misuse of the service.

 12. Dispute Resolution and Governing Law

Any dispute or claim arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA). You waive your right to participate in a class-action lawsuit or class-wide arbitration.

This Agreement is governed by the laws of the State of Idaho, without regard to conflict of law provisions.

California Residents: Certain provisions regarding class-action waivers and limitations of liability may not apply to you under California consumer protection laws.

13. Modifications to These Terms

Effectiv reserves the right to update or modify these Terms of Use at any time. Any changes will become effective immediately upon posting to the platform. Your continued use of the platform constitutes acceptance of the revised Terms.
